The Court of Appeal sitting in Abuja on Monday August 26th, dismissed an Appeal brought by Anslem Ojezua challenging the June 26th judgement delivered by Justice Omotosho of the Federal High Court Abuja, which upheld the validity of the February 22 Guber primaries of the People’s Democratic Party (PDP) in Edo State.
The Court of Appeal also confirmed Dr. Asue Ighodalo as the validly nominated Governorship Candidate of the People’s Democratic Party(PDP) in Edo State.
In a unanimous judgement delivered by Justice Obiora JCA in the suit marked CA/ABJ/CV/775/2024, the Appeal court held that the lower court was right in holding that the appellant’s case was premature as the Appellant, Ojezua failed to adhere to the internal dispute resolution mechanism and rules of the Peoples Democractic Party before filing his case in court.
“The party rules are binding on the parties and is a condition precedent to bringing this case to court. There is nothing placed before the court to show that the appellant, Ojezua filed any appeal to the party therefore I cannot fault the lower court’s finding” The Court Stated
The Appellate court consequently dismissed Ojezua’s Appeal accordingly.
With this development, the coast is clear for Asue Ighodalo to remain in the race as the Gubernatorial flag bearer of PDP in the forthcoming September 21st Guber Election in Edo State.
